These Terms of Use (“Terms”) are a binding agreement between you and the operators of the Bahria Enclave Properties portal (“we”, “us”, “our”, the “Platform”). By accessing the Platform, browsing listings, creating an account, submitting a listing, contacting an advertiser, or otherwise using any part of the service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Platform.
1. What the Platform is — and is not
- We only advertise. The Platform is a neutral venue that lets residents and agents publish property advertisements and lets other users discover and contact them. We are a classifieds/advertising board, nothing more.
- We are not a real-estate agency, broker, dealer, valuer, or legal/financial advisor. We do not represent buyers or sellers, do not negotiate, and do not participate in any deal.
- We do not own, inspect, endorse, or guarantee any property, listing, price, or user. Listings are submitted by users. We do not verify ownership, title, possession, measurements, approvals (LOP/NOC), encumbrances, or the truth of any statement in a listing.
- Contact-number verification is not an endorsement. We verify a lister’s mobile number by SMS one-time-password only to reduce anonymous abuse. Verifying a phone number does not mean we have verified the person’s identity, honesty, ownership of the property, or the accuracy of the listing.
2. No liability for transactions, fraud, or dealings between users
- Any transaction, negotiation, payment, token/advance, agreement, or dispute is solely between the Buyer/Renter and the Seller/Lister. We are not a party to it and bear no legal or financial liability of any kind arising from it.
- To the fullest extent permitted by law, we are not liable for any fraud, scam, misrepresentation, forgery, non-delivery, defective title, double-selling, price manipulation, impersonation, theft, loss of money, or any other wrongful act by any user or third party, whether a Seller, Buyer, agent, or anyone else.
- We do not guarantee that any listing is genuine, that any advertiser is who they claim to be, that any property exists, is available, is legally transferable, or is free of disputes or dues.
- We are not responsible for the quality, safety, legality, or availability of any advertised property, nor for the ability of a Seller to sell or a Buyer to pay.
3. Your duty to verify — both sides
Because we do not vet listings, you must carry out your own due diligence before parting with any money, documents, or possession. This applies to both sides of every deal:
- Buyers/Renters must independently verify, at minimum: the advertiser’s identity and CNIC; genuine ownership and clear, transferable title; original property documents; possession status; society approvals, LOP/NOC and dues clearance; plot/house measurements and location; outstanding utility bills and taxes; and that the price and terms are as represented. Insist on originals, meet in safe/official settings, and use lawful, traceable payment methods. Consider engaging a qualified lawyer and the relevant society/authority offices before paying.
- Sellers/Listers must likewise verify the Buyer’s identity, genuineness, and source of funds, and must never hand over documents or possession against unverified or reversible payments.
- Never share sensitive credentials. No one legitimate — including us — will ask for your EasyPaisa/bank PIN, OTP, or password. Treat any such request as a scam.
You accept full responsibility for the consequences of proceeding without proper verification.
4. Consent required to post a listing
When you submit a listing you must actively accept these Terms. By submitting, you represent, warrant, and consent that:
- You are the lawful owner of the property or are duly authorised by the owner to advertise it, and you have the right to enter into the resulting dealings.
- All information, photographs, prices, and details you provide are true, accurate, current, and not misleading, and the property is genuinely available on the stated terms.
- Your listing and conduct comply with all applicable laws and with these Terms, and do not infringe anyone’s rights.
- You consent to your submission being recorded together with technical metadata — including your IP address, browser/device information, referrer, and timestamps — for security, moderation, fraud-prevention, and legal/record-keeping purposes, as described in our Privacy Policy.
- You authorise us to display, adapt, and distribute your listing content on the Platform and in related community channels, and to remove or moderate it at our discretion.
5. Prohibited conduct
You must not: post false, fraudulent, duplicate, or misleading listings; advertise property you do not own or are not authorised to advertise; impersonate any person; harvest other users’ data; post unlawful, obscene, defamatory, or infringing content; use the Platform to defraud, harass, or spam; circumvent verification or security; or use bots/scrapers. We may remove any listing and suspend or delete any account at our sole discretion, without notice, and may report unlawful activity to the authorities.
6. Record-keeping and cooperation with authorities
For the protection of the community and for legal purposes, we record submission metadata (see the Privacy Policy), including the IP address and browser/device details from which a listing or inquiry is submitted. We may retain and disclose this information to law-enforcement or other lawful authorities in response to a valid request, or where we reasonably believe it necessary to investigate fraud or protect users.
7. Disclaimers
The Platform and all content are provided “as is” and “as available”, without warranties of any kind, express or implied, including as to accuracy, availability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that listings are accurate or lawful. Nothing on the Platform constitutes legal, financial, valuation, or investment advice.
8. Limitation of liability
To the maximum extent permitted by law, we, our operators, owners, volunteers, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of money, property, profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Platform, any listing, any transaction or dealing between users, or any fraud or wrongful act by any user or third party — whether based on contract, tort, negligence, or any other theory, and even if advised of the possibility of such damages. Where liability cannot be excluded by law, it is limited to the greatest extent permitted.
9. Indemnity
You agree to indemnify and hold us harmless from and against any claim, demand, loss, liability, cost, or expense (including reasonable legal fees) arising from your use of the Platform, your listings or content, your dealings with other users, your breach of these Terms, or your violation of any law or third-party right.
10. Intellectual property and takedowns
You retain ownership of content you submit but grant us a non-exclusive, royalty-free licence to host, display, and distribute it in connection with the Platform. 11. Suspension and changes
We may modify, suspend, or discontinue any part of the Platform, and may update these Terms, at any time. Material changes take effect when posted here with a new “last updated” date; your continued use after changes means you accept them.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Islamic Republic of Pakistan. You agree to the exclusive jurisdiction of the courts at Islamabad for any dispute arising out of or relating to the Platform or these Terms, without prejudice to any mandatory consumer protections available to you.
13. Severability
If any provision of these Terms is held unenforceable, the remaining provisions continue in full force, and the unenforceable provision is replaced with an enforceable one that most closely reflects its intent.
